1. Introduction & Acceptance

Welcome to Flowtix ("we", "our", "us"). These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Flowtix Ltd, concerning your access to and use of the flowtix.co.uk website and our related applications and services. By accessing or using our services, you agree that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree, you are expressly prohibited from using the platform and must discontinue use immediately.

2. The Flowtix Platform

Flowtix acts solely as an intermediary technology platform connecting customers seeking local services with businesses providing those services.

• For Customers: We provide a platform to discover, book, and review local businesses. When you make a booking, your contract for the provision of services is directly with the business, not Flowtix. We do not provide the services and are not liable for the quality, safety, or legality of the services booked.
• For Businesses: We provide scheduling software, a public directory listing, and payment routing infrastructure. You are solely responsible for fulfilling the services advertised on your profile and complying with all applicable laws and regulations in your jurisdiction.

3. Account Registration & Security

To use certain features, you must register for an account using Clerk authentication. You must provide accurate and complete information and keep your account details updated. You are entirely responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account. Flowtix reserves the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in fraudulent activity.

4. Fees, Payments, and Subscriptions

Business Subscriptions: Access to premium business features (e.g., Business or Enterprise tiers) requires a paid subscription. Subscription fees are billed in advance on a recurring basis and are non-refundable. We reserve the right to change our pricing upon providing reasonable notice.

Booking Payments: Any deposits or payments processed for appointments are securely routed directly to the respective business's Stripe Connect account. Flowtix does not hold these funds. Any refund requests must be directed to the business you booked with, subject to their individual cancellation policies.

5. User Conduct & Reviews

You agree not to use the platform for any unlawful purpose. When leaving reviews, you must ensure your feedback is accurate, based on genuine experiences, and does not contain defamatory, offensive, or discriminatory content. Flowtix reserves the right to remove any content that violates these guidelines without notice.

6. Intellectual Property

The platform, including its original content, features, functionality, and design, are owned by Flowtix Ltd and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the platform without our express written consent.

7. Limitation of Liability & Disclaimers

The platform is provided on an "AS-IS" and "AS-AVAILABLE" basis. To the maximum extent permitted by applicable law, Flowtix and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the platform, the conduct of any third-party business, or any unauthorised access to our servers.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the English courts.
